Participation Rules

1. General

Unless otherwise defined in this Agreement, the terms defined have, throughout their use in this document, the following meaning:

Ticket
A certificate issued in electronic form and having a unique identification code that certifies the right to a wristband at the Promoter’s Festival; tickets may be non-nominal or nominal; Tickets in the broad sense include full passes as well; additionally, invitations are also considered Tickets, according to section 3.1 below.
Wristband / Chip Wristband
A certificate offered by AFTERHILLS after the Ticket validation (by scanning the unique serial code), which offers its bearer rights identical to those included in the Ticket and which, subject to the following security conditions, certifies the right of its bearer to attend the Festival; the ONLY payment method within the Festival.
Festival Duration
The time between the beginning and the end of the Festival. The beginning of the Festival will correspond to the beginning of the validity of the Tickets at the Festival, which authorizes the first entrance to the Festival. The end of the Festival will correspond to the end of the validity of the Ticket authorizing the longest stay at the Festival.
(The) Festival
AFTERHILLS Festival, organized and staged by AFTERHILLS, made up of all the art programs of the show – music, improvisation, stand-up, choreography, theater, entertainment and culture – and other free or paid Services offered by AFTERHILLS (directly or through contract partners) for a certain amount of time and at a particular location. In 2019, the Festival takes place between August 23rd – 25th and August 30th – September 1st, 2019, in Dobrovăț, Iași, România.
Contractual Partner
a natural/legal person that carries out business activities at a particular Festival, as stipulated by contract with AFTERHILLS.
Participants
All people participating in the Festival, whether they are Authorized Participants or Unauthorized Participants.
Authorized Participant
Buyer of a Ticket and Visitor.
Unauthorized Participant
Individual who participates in the Festival without a valid right to enter the Festival grounds.
Product
The objects that can be acquired/purchased from AFTERHILLS or other Contractual Partners within or in connection with the Festival, as well as any vouchers or similar means that may be offered in exchange for them.
Promoter/AFTERHILLS
AFTERHILLS S.R.L., Romanian company, based in Iași, Vasile Lupu street, no. 78A, bl. N3, ap. 57, room 1, Iași county, registered at the Trade Register under no. J22/1653/2016, fiscal code RO36328743.
Regulations
these general terms and conditions governing the conduct of any Festival, available on the Site (as defined below) as well as in other visible areas of the Festival Area or made public by other means.
Service
Any service provided by AFTERHILLS or its Partners in or about the Festival, free of charge or for a fee.
Website
The AFTERHILLS website, i.e. the website available at www.afterhills.com.
Third Parties
natural and legal persons other than AFTERHILLS, Visitors or Buyers of Tickets.
Visitor
Individual with the right to enter and attend the Festival.
Festival Area
the location where the Festival takes place, namely Dobrovăț: 25 kilometers from Iaşi center, at the exit towards DN24; The Festival Area includes the camping area as well.

2. Applicability

The present agreement:

  • will be applied to:
    1. the participation of Visitors or Ticket Buyers (or subsequent Legally Owners of Tickets) at any Festival;
    2. Unauthorized Participants;
  • ways out the rights and obligations arising from participation to the Festival;
  • marks the conclusion of the contractual relationship between Authorized Participants and AFTERHILLS;
  • is valid for indefinite periods, AFTERHILLS having the right to modify it unilaterally, without prior notice to Participants, and they expressly agree to this; the changes take effect immediately after publishing on the site, and may also occur after the purchase of the Ticket, immediately and immediately before the Festival;
  • does not create, for the Unauthorized Participants, any rights in the relationship with AFTERHILLS, as AFTERHILLS does not enter into a contractual relationship with them and does not assume any obligations towards them.

3. Tickets

Participation in the Festival is made using one of the following types of tickets:

Festival Pass Weekend 1
allows the Authorized Participant’s access to the Festival Area throughout its duration from the first day from 14:00 PM to the end of the Weekend, August 26th, 9:00 AM;
Festival Pass Weekend 2
allows the Authorized Participant’s access to the Festival Area throughout its duration from the first day from 14:00 PM to the end of the Weekend, September 2st, 9:00 AM;
Festival Pass Double Weekend
allows the Authorized Participant’s access to the Festival Area throughout its duration from the first day from 14:00 PM to the end of the second Weekend, September 2st, 9:00 AM;
Day ticket
allows the Authorized Participant’s access to all Festival stages and locations on that day from 09:00 AM to 09:00 AM the next day, when the Ticket becomes invalid and the Participant’s right to access the Festival expires.
All type of tickets + Camping Access / Accommodation
allows access to the Authorized Participant inside the Festival for the entire duration of the Festival, according to their tickets.

Participation in the Festival is also done using one of the following types of invitations (which will be referred to as Tickets):

Invitations
allow the Authorized Participant’s access to the Festival, according to their type of invitation (Festival Pass Weekend 1, Festival Pass Weekend 2, Festival Pass Double Weekend + Camping Acces / accommodation, Day ticket).

By purchasing the Tickets, their Buyers (or invitations holders) undertake to comply with this Regulation, the procedures for obtaining/issuing/validating the Tickets, the Rules of Access to the Festival and any other rules for participation to the Festival, which are brought to knowing through various means, including directly through the Website.

The Tickets are purchased online through the AFTERHILLS system, available on the AFTERHILLS website.

Acquiring Online Tickets from www.afterhills.com is made using the EuPlatesc.ro payment system. Similarly to Tickets purchased through Contract Partners, the payment is not processed directly by AFTERHILLS.

The Promoter only guarantees the validity of Tickets sold through the AFTERHILLS system, available on the www.afterhills.com Website or through the Contract Partner Networks.

The purchase of tickets/wristbands/invitations from areas other than those authorized by the Festival Promoter is forbidden and results in restricting access to the Festival and bearing legal consequences by those who purchase/use them.

The tickets ensure the access of one person alone in the Festival.

It is strictly forbidden to sell or buy invitations, as well as to sell overpaid tickets and/or full passes. The Promoter reserves the right to act in accordance with the law to punish those who will be found to carry out such activities and to cancel the Tickets.

The purchaser of the Ticket has the right to notify in writing the Promoter that he/she wants to return the Purchased Tickets online, without invoking a reason, within 14 days of receipt of the Order Confirmation.

Moving the Festival to a place in the same city is not a reason for reimbursement of tickets.

The right of withdrawal may be exercised in accordance with the terms and conditions set forth in the Online Shop Terms and Conditions, available at www.afterhills.com.

Purchased tickets can not be replaced. The only replacement option is for day tickets/passes that can be upgraded to Festival Pass Double W (with or without camping access) with a price difference.

Except for the exercise of the right of withdrawal in accordance with the above mentioned issues, no refund will be granted if the Buyer of the Ticket or any person other than the Buyer who is legally in possession of the Ticket or Wristband does not wish to participate or may not participate in the Festival for any reason (other than force majeure) or if the Visitor leaves the Festival before the time at which he would have been entitled to attend the Festival. Loss of the Ticket leads to the loss of the right to participate in the Festival.

The Promoter reserves the right to modify the price of the tickets/passes without any previous notification in this respect.

If, upon access to the Festival Area, the Ticket Holder is suspected of acquiring the Ticket illegally, AFTERHILLS expressly reserves the right to require the Ticket Holder to submit documents and/or certificates to verify the purchase or legal purchase of the Ticket, the right to assess whether they are valid and compliant, and in the absence of a satisfactory document or certificate, reserves the right to invalidate the Ticket without any obligation to repay the purchase price and refuse entry to the Festival Area.

The legal possession of the Ticket gives the right to receive, after Tickets are validated, Wristbands that will have colored cards associated with the type of Ticket.

The cards attached to the wristbands will differ as facilities depending on whether the Participant has purchased additional options or not, such as, for example, access to camping.

After changing the Ticket with a Wristband, the Wristband will encompass the rights and obligations of the Ticket. The Promoter warrants that the Participant holding a valid Ticket may remain in the Festival Area and may use all the Services offered by the Promoter.

AFTERHILLS will register and link the Visitor’s Wristband (having attached a type of card, according to the info explained above) during the entry procedure. During this procedure, the Promoter has the right to request the verification of the Visitor’s identity through a valid document of personal identification that contains the photo of the Ticket Holder. If the Visitor refuses to comply with this request, AFTERHILLS will have the right to invalidate the Wristband, with no obligation of reimbursement of the purchase price, as well as the right to refuse the person’s access in the Festival.

Wristbands
  • are non-transferable and non-transmissible;
  • must be worn throughout their entire availability period, on their wrists or, exceptionally (if there is justification), in another visible place, provided that the Wristband cannot be removed without being damaged;
  • may be inspected at any time by the Promoter or his/her representatives throughout the duration of the Festival, at the entrance, at the exit and throughout the Festival’s perimeter;
  • is the exclusive and full liability of the Visitor for any damage or loss, AFTERHILLS not having the obligation to replace damaged or lost Wristbands;
  • damaged wristbands or wristbands that have been resealed or cut, whose closure system has been opened, those having a larger diameter than the wrist of the wearer, or that have been interfered with in any way, are NOT valid; Participants with damaged Wristbands lose their right to be in the Festival Area, being excluded from it. In case of loss, damage of any kind to the Wristband, the Participant is forced to purchase a new Ticket for that day if he/she wishes to remain in the Festival Area. If the Wristband proves to have been fraudulently damaged, the Participant is required to purchase a Day Ticket regardless of whether or not he wishes to remain in the Festival Area; The person who obtains a Wristband in exchange for an illegally acquired Ticket or a third party who participates in a particular Festival with such a Wristband does not have the status of Authorized Participants.

4. Festival Access

Access to the Festival Area is possible only at the specially arranged entrances and at the times designated in advance by the Promoter, exclusively for the Authorized Participants, strictly following the procedures provided by this Regulation.

Participants are required to have identity papers next to the Ticket. At the request of the security team or representatives of the Promoter or other competent authorities, the Participant has the obligation to present the access documents and identity papers.

Each Entrance to the Parking Area will be paid by the Participant for the amount of 5 RON, the equivalent of a Parking Ticket. If the Participant leaves the Parking Area and returns the same day or the following days, they must acquire another Parking Ticket.

At each access area, the Participant acknowledges and agrees with this Regulation, which will be displayed visibly in these areas, in addition to the other means of making it public, such as through the www.afterhills.com website.

To ensure the safe run of the Festival, AFTERHILLS reserves the right to restrict the type of objects and devices that can be brought inside the area.

It is forbidden to enter the Festival Area with the following:
  • drugs or other narcotic substances;
  • fireworks;
  • lasers;
  • sprays;
  • knives, weapons, sharp objects or other dangerous goods of this kind;
  • pyrotechnic articles;
  • gas sprays;
  • umbrellas;
  • explosive materials;
  • professional photo or video cameras, including DSLR & drones;
  • fireworks;
  • food and beverages;
  • any type of objects that may cause injury to other participants.
Access to the following items is allowed
  • compact cameras;
  • GoPro cameras;
  • external batteries;
  • lighters;
  • small size selfie sticks;
  • drugs; insulin; drops – medicinal use; inhalation spray for asthma (any such products are only allowed if they are accompanied by a medical letter or any other document replacing it and in a maximum of one daily dose);
  • camping accessories, tents and mattresses (allowed exclusively in the camping area).

Due to very strict rules on prohibited items, those responsible for the security and monitoring of the Festival will be able to search each participant in detail and any prohibited articles discovered after verification will be stopped at the gate without the Promoter assuming any responsibility to them.

In the festival area:
  • it is forbidden to enter by car/RV (with the exception of the specially designed camping area), rollers, skates, bikes, hoverboards or other devices of this kind;
  • pets are not allowed;
  • in some places, if they are overcrowded and are deemed to have reached their maximum authorized capacity, the Promoter reserves the right to temporarily stop Participants from gaining access to their comfort.

It is forbidden for minors to consume alcohol, cigarettes and drugs. To prevent such consumption, minors will receive Wristbands of a different color, which will not allow them to buy these products.
Important! The noise produced by the Festival is very powerful. The Promoter recommends that minors under 7 do not attend the Festival. Minors under 4 years must wear earphones.

Minors under 14 have free access to the Festival and can attend the Festival only in the company of a parent or other accompanying adult as legal guardian (guardian), subject to a written and signed parental agreement. At the request of the staff responsible for security and monitoring, as well as representatives of the Promoter, the attendant has the obligation to present documents (student card, passport or any other document containing the child’s photo) attesting the minor’s age.

Access for minors between 14 and 18 years of age will be made only on the basis of a valid (non-discount) Ticket and identity card and is conditional upon the submission of a signed Legal Representative Declaration.

Important! Access for minors under 18 years of age is strictly forbidden in some areas of the Festival marked in this respect.

Children with disabilities as well as adults with serious or severe disabilities receive free access to the festival on the condition that they submit an application accompanied by (i) a copy of their invalidity certificate and (ii) a copy of their identity document. These documents must be submitted at any time during the Festival and at the request of the Security Team or the Promoter’s representatives.

The application must be submitted via the Online Form. In order to enter the Festival, the individuals must have their ID and confirmation received by e-mail after the Promoter evaluates their application.

Accompanying children with disabilities as well as adults with serious or severe disabilities benefit from the Ticket free of charge only if they prove, by any kind of supporting papers, that they are caretakers of the person with disabilities they accompany.

5. Products and Services Offered within the Festival. Payment. Refunds

In the Festival Area there will be points where Participants can get the Products and Services made available by the Promoter (directly or through the Contract Partners).
For the purchase of Products and Services made available by the Promoter directly or through the Contract Partners in the Festival Area, Participants are required to use only the methods and payment systems established and communicated by the Promoter.

The payment method for the products and services offered in the Festival Area are the payment devices (RFID) made available by AFTERHILLS through the Intellitix service, respectively the Integrated Chip Wristband, with the corresponding card attached.

Each Participant has the obligation to get the Chip Wristband at the entrance of the Festival Area (with the integrated payment system), this being the only way to purchase the Products and Services available in the Festival Area. Cash Payment in the Festival Area is strictly prohibited, outside the areas previously established by the Promoter and where the Wristbands can be loaded with Credit Points.

Charging/recharging the Chip Wristbands can be done either by cash or by bank card. The conversion is: 1 leu – 1 credit point.

Contract Partners will be required to issue tax vouchers to Customer Participants (as well as invoices at the Participants’ request). If a Participant wishes to receive a tax invoice for the Products/Services purchased within the Festival, he/she has the obligation to keep all tax receipts from each trader (Contractual Partner), for the subsequent application of the tax invoice from the respective Contracting Partners.

Refund of Chip Wristband Amounts
Automatic refund
participants who created an account on afterhills.pay.intellifest.com will automatically be transferred the amount of money left on the AFTERHILLS wristband in the bank account they registered with, without any further steps.
Manual refund
by form
after the closing of the Festival, Participants can withdraw their money by completing the Refund form from their AFTERHILLS account until September 16th. By submitting the application, Participants will also need to mention the bank account to which their money will be transferred. The return of the remaining amounts on the Chip Wristband is made by bank transfer within 14 working days of the submission of the request.
at the Credit Points
for the duration of the Festival, Participants will be able to recover unused amounts in certain Credit Points; the cash refund program will be available from the beginning of the Festival until September 2nd, 2019, 09:00 AM.

For the refund of the unused amounts, a processing fee of 5 RON will be automatically withdrawn from the registered bank account.

6. Behavior During the Festival

In the Festival Area:
  • Participants must refrain from any action that may threaten and endanger the life, health or security and the rights of others;
  • It is prohibited for Participants to damage/destroy the AFTERHILLS or its Contract Partners’ environment or installations, buildings and green areas;
  • it is forbidden to carry out any commercial/advertising activity without the prior written consent of the Promoter;
  • alcoholic beverages may not be offered to Participants under 18 years of age or to intoxicated persons;
  • the use of substances qualifying as prohibited drugs under the applicable law is prohibited;
  • Visitors have the obligation to fully cooperate with the Promoter or its Contract Partners and comply with their instructions in case of emergency or if other significant circumstances justify it.

7. Rules of Conduct in the Camping Area

AFTERHILLS offers camping and accommodation facilities during the Festival. Camping facilities and their prices will be published on the Festival’s website.

The camping area will be open starting August 23, 2019 (14:00 PM), until September 2nd, 2019 (09:00 AM). During this time, the camping area will be open non-stop. Participants have the right to access and leave the camping area whenever they wish.

It is forbidden to enter the campsite area with any vehicle, except for vans/RVs. The perimeter of the campsite will be supervised by the security guards, but it is not advised to leave valuables in the tent. The promoter is not responsible for lost or stolen items. In such cases, Participants can contact the festival’s information point or lead them to the Lost and Found points.

Camping Access is made through the scanning of the RFID wristband. All Participants will be subjected to body searches and luggage checking at the entrance to the Camping Area.

Items forbidden from the Camping Area are mentioned in section 4.1 above. Confiscated objects will not be returned to the Participant. They have the right to return and leave the items in the car.

The Camping Area has showers, toilets, shops, utilities.

Any damage to: toilets, showers and other objects in the Camping Area will be borne entirely by the responsible person.

The participant will respect the laws and rules of social conduct in Romania.

8. Recordings Made at the Festival

The Promoter and its Contract Partners, as well as accredited media, have the right to photograph and record programs during the Festival. The Promoter has the right to use these recordings in the advertising campaigns and to publish the photographed/filmed material without the written consent of the Participants. Therefore, all Visitors, by virtue of their participation in the Festival, grant the Promoter (as well as those authorized by the latter), by acknowledging this Regulation, express permission to record and publish their image, appearance, and actions.

Provided that the materials are in connection with the Festival, the person making the recordings according to the above rules will obtain Transferable and Exclusive Use Rights on Visitor Records. Visitors expressly acknowledge and accept that AFTERHILLS and persons authorized by AFTERHILLS may record the Festival, concerts and programs, copy the recordings and distribute them by image carriers, broadcast or otherwise make them public (having the unrestricted right to profit from these operations) and can do so repeatedly, including by informing the public about the Festival, concerts and programs by means of cable data transmission or by any other means (e.g.: YouTube). Visitors are not entitled, within the limits of legal provisions, to claim against AFTERHILLS or AFTERHILLS Authorized Persons in connection with their registrations and publication as described above.

Participants have the right to photograph and film in the Festival Area, but only in areas where access is permitted and only with non-professional equipment. Participants will not be able to use the filmed/photographed material for commercial purposes and will not be able to communicate to them publicly unless the personal rights of the photographed/filmed Visitors are respected.

The promoter has the right to establish areas/locations with prohibited shooting/filming. In the event of non-compliance, the Promoter has the right to confiscate the camera/video until the end of the Festival and to delete those records. The Promoter also reserves the right to totally prohibit the shooting and recording of videos during certain performances, as there are artists who do not allow any record of their performance (which will also be announced on the AFTERHILLS Facebook page).

9. Security Measures

The promoter will take the necessary steps to ensure that Participants are informed about the protection and prevention measures in the Festival Area.
For the good performance of the Festival, the participants have the following obligations:

  • to inform the security team about any situation they have reason to believe is dangerous to others;
  • to notify the security team of any incidents they have incurred.

In the event of a violent incident, the security team may decide to evict the Participants involved in the incident from the Festival Area.

10. Limitation of Liability

AFTERHILLS makes no warranties regarding the duration of the Festival entry process or the availability, content, quality, and quantity of the Festival’s Programs and Services, and explicitly excludes Visitor’s reimbursement of the Ticket price or the granting of a subsequent reduction or payment of damages-interests, compensation or indemnifications of any kind in this context.

Within the Festival, the Promoter reserves the right:
  • to modify the event dates in case of force majeure or unforeseen circumstances;
  • to modify the program unilaterally, depending on the various situations that may arise along the way;
  • to modify, restructure and further develop the Festival, Services and Products offered at the Festival, at its choice, as required.

Visitors are not entitled to raise any claims against AFTERHILLS regarding the above changes, restructurings or developments.

However, AFTERHILLS will use its best endeavors to provide the Programs and Services communicated in advance and, if necessary, to replace the canceled Program or Service previously communicated with another Program or Service.

In the event that the Festival is canceled or postponed due to the Promoter’s fault, AFTERHILLS undertakes the responsibility to return the amounts relating to the Tickets in full within 30 days of the cancellation/deferment of the Festival.

In the event of the withdrawal of one of the confirmed artists at the Festival, be it as a head, the Promoter does not take responsibility for reimbursing the amount of the Ticket payment.

AFTERHILLS has no obligation to cancel the Festival in case of unfavorable weather. If the authorities request the suspension or closure of the Festival by AFTERHILLS for reasons of force majeure, the Festival or part of it will be canceled.

Visitors are expressly mindful of the fact that they may also purchase Products and Services in connection with the Festival, which are offered by other Contract Partners, and not by AFTERHILLS. In such cases, the rights and obligations arising from the agreement between the Visitor and the Contract Partner apply exclusively to the Visitor and the Contract Partner. Visitors expressly confirm that they can not raise any claim against AFTERHILLS in relation to the Products and Services concerned or in connection with the contract for such Products and Services. AFTERHILLS assumes no liability for damages arising out of or suffered in connection with the purchase or use of Services and Products provided by the Contract Partners.

AFTERHILLS will only be liable for intentional contractual breaches imputable to it and for breaches of contract that endanger human health, integrity or physical health if such damage is caused by AFTERHILLS and excludes any liability beyond the Participants’ explicit legal rights in relation to any other harm, including those that affect human life, integrity or physical health or material damage.

Visitors and Unauthorized Participants are fully and solely liable for any damage they have caused to the AFTERHILLS Festival, its Contract Partners, other Visitors, and Third Parties at the Festival or in connection with the Festival.

AFTERHILLS may only be held liable for damages incurred in the Festival Area if the conditions set out in this Regulation are met for the liability of AFTERHILLS and are not liable for any damage that may occur outside the Festival Area or on the way to or from the Festival Area.

In the event that a Participant violates any provision of this Regulation in connection with the Festival, AFTERHILLS may invalidate the Participant’s Ticket or remove the Wristband, and the Participant will be required to leave the Festival. The Unauthorized Participant is not allowed to participate and must leave the Festival Area without delay. In addition, AFTERHILLS has the right to impose on that Visitor/Non-Participant a partial participation ban (applicable to one or more Festival editions) or total (applicable to all AFTERHILLS Festivals).

Participants take full responsibility for their physical/psychological capacity to participate in various activities within the Festival (which also involve the risks associated with increased effort).

Participants take full responsibility for themselves, including in the following situations:

  • for participants suffering from mental or physical illness (including epilepsy) and minors, powerful noise or special audio and visual effects (including light games) as well as, but not limited to, crowded areas are considered a risk; Participants undertake responsibility for any damage they may suffer;
  • for the area of activity, hot air balloons, pillow battles, labyrinths, bungee jumping and other activities that may pose a high risk of injury, the Participants expressly assume that they have the physical and mental condition to take part in such activities;
  • the Promoter does not take any responsibility for any damage or injury that may result from fireworks.

With regard to lost objects, the Promoter will arrange a Lost and Found Point where such objects can be brought and where each owner can recover his/her property insofar as it can justify the fact that they belong to them, within 72 hours, but no later than September 2nd, 09:00 AM. Within 7 days from the end of the festival, unclaimed items will be posted on the Facebook page of the Festival in the attempt to find the owners.

AFTERHILLS does not operate storage facilities within the Festival. The promoter is not responsible for the Participants’ goods or for any damage to their products.

Information on Wristbands, Passes, payment, regulations and other issues strictly related to the festival will be provided within the Info Point outside the Festival.

11. Medical Assistance

The Participant agrees to receive the medical treatment that may be considered appropriate in the event of injury, accidents or illness during the Festival, and completely exonerates AFTERHILLS and all people participating in the medical treatment for any such actions within the limits of the legal provisions.

In the Festival Area, first aid and medical assistance will be provided in the continuity regime.

12. Copyright

Anything posted on the Site, as well as on various types of media in the Festival Area or in connection with the Festival, such as, but not limited to, names, logos, domain names, images, texts, graphics elements, symbols, databases, etc., is the property of AFTERHILLS and/or its contractual partners.

Visitors and Third Parties may not use, copy, distribute, publish, or incorporate such information into any other documents or materials in order to obtain revenue without the prior written and express permission of AFTERHILLS and/or its Partners.

The images, logos, texts of the AFTERHILLS Partners’ Affiliates belong to them (or AFTERHILLS, if they have been divested to it) and are reproduced on the website, in the Festival Area or in connection with the Festival with their consent.

13. Personal Data

AFTERHILLS processes your personal data in compliance with the applicable legal requirements. Details on how to process are found in the Privacy Policy section available at www.afterhills.com.

14. Disputes

Any conflict arising between AFTERHILLS and its customers as a result of participating in the Festival or the use of the website will be settled amicably. If this is not possible, the resolution of conflicts is a matter for the Romanian courts.

15. Force Majeure

In cases of force majeure (as defined by the Civil Code), the Promoter may decide to make changes or cancel the Festival in exceptional circumstances.
